IMCS is concerned about the privacy rights of its clients, visitors to its Websites ("Site") and the security of their data. Accordingly, we have adopted this Privacy Policy ("Privacy Policy") for this Site to ensure responsible use of the information you share with IMCS and to make you aware of the terms and conditions of your use of this Site and our services.

This Privacy Policy is incorporated by reference into IMCS ’s client agreements. As used herein, the term "IMCS" includes any and all divisions, affiliates and subsidiary companies of IMCS, if any.

Data type collected

We automatically track and collect the following information when you visit our Site, including your:

  • IP address
  • Host name
  • Computer operating system
  • Requested page
  • Referring URL
  • Time of visit; and
  • Type of web browser (collectively "Traffic Data")

Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving a visitor’s experience on the Site.

Personal Information

In order for you to purchase services that we offer via the Site, we require you to provide us with information that personally identifies you ("Personal Information"). Personal Information may include:

IMCS uses "cookies" in providing services and to enhance your experience on the Site. User information collected

IMCS uses the Personal Information it gathers to assist us with providing you the best online experience possible. We use Contact Data to send information about our company and services, or promotional material from some of our partners, or to contact you when necessary about the services we provide you. We reserve the right, in our sole discretion, to send bulletins and other important information to you. We use your Financial Data to verify your qualifications for certain services and to bill you for services. We use your Demographic Data to gather general interest in our services, to help in the analysis of service usage, purchasing and target markets. Domain name customers who have registered a domain name with IMCS and wish to change the Technical Contact to another company, may do so by visiting http://www.IMCS.net/. It is important to note that customer domain name registration information is made publicly available in the registry of domain names.

Sharing of Personal Information

IMCS uses Personal Information primarily for our own internal purposes, such as providing, maintaining, evaluating, and improving our Services and the Website, fulfilling requests for information, producing and shipping the products that you order, and providing customer support. Your personal information will not be shared with third party vendors, advertisers or data collectors.

User Choice Regarding Collection, Use and Distribution of Personal Information

You may choose not to provide us with any Personal Information. In such an event, you can still access and use some of the Site; however you will not be able to access and use those portions of the Site that require your Personal Information and you will not be able to purchase services from us. If you do not want us to share your Contact Data with any third parties, please change your settings in the Support section of our Site. However, users may not "opt out" of receiving information from IMCS which is related to maintaining or updating client accounts and system information or our release of Contact Data pursuant to court orders or criminal investigations.

Confidentiality and Security of Personal Information

Except as otherwise provided in this Privacy Policy, we will use commercially reasonable efforts to keep your Personal Information private but it will be necessary to disclose such information to: (a) protect our rights or property; or (b) enforce this Privacy Policy or any agreement between you and IMCS.

Your Personal Information is stored on servers that are generally not accessible by third parties and a minimal number of our employees have access to your Personal Information. All Financial Data is transmitted using Secure Sockets Layer (SSL) protocol, which encrypts your information and confirms the identity of the IMCS server before completing the transaction. To ensure you that such information is secure, look for the picture of the unbroken key or closed lock in your browser window. Either indicator means SSL is hard at work. Another way you can tell if SSL is guarding your transaction is to check the URL of the Website. It should change from "http" to "https" when processing secure transactions.

User Ability to Access, Update and Correct Personal Information

In order to ensure that all of your Personal Information is correct and up-to-date, at any time you may visit your profile in the Support section of our Site. Through your profile you may:

(a) review and update your Personal Information that we have already collected;
(b) choose whether or not you wish us to send you information about our company or promotional material from some of our partners; or
(c) choose whether or not you wish us to share some of your Personal Information with third parties.

Use of the Site

The Site is owned and operated by IMCS. No materials found on the Site or any other site owned, operated, or licensed by IMCS may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way except as expressly provided by IMCS. You may not distribute, modify, transmit, reuse, repost or use the content of the Site without IMCS prior permission. IMCS neither warrants nor represents that your use of materials displayed on the site will not infringe rights of any third party. Because of the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content, including all laws, rules, codes and regulations of the country in which you reside.

Links to Third Party Websites

If you use any links provided in the Site to Websites not owned, maintained or hosted by IMCS ("Off-Sites"), you will leave the Site. IMCS is not responsible for any Off-site's privacy policies or terms of use. No warranty is made with respect to the accuracy, timeliness, or suitability of the content of any Off-Sites, and IMCS takes no responsibility for such sites. A link to an Off-Site is not an endorsement of the Off-Site, its content, or its sponsoring organization.

Limitation of Liability

Under no circumstances, including but not limited to negligence by act or omission, shall IMCS or any party involved in creating, producing, or delivering the Site or its content, be liable for any direct, incidental, consequential, indirect or punitive damages that result from the use of, or the inability to use the materials on the Site, even if IMCS or a representative authorized by IMCS has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event, however, shall IMCS 's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Site.

Jurisdictional Issues

Your use of the Site, and the terms of this Privacy Policy, shall be construed and controlled by the laws of the Australia. Further, any dispute arising from your use of this Site or the terms of this Privacy Policy, or a breach there of, shall be governed by the laws of Australia. By accessing the Site, you agree to personal jurisdiction by the state and federal courts within Australia. The sole and exclusive jurisdiction and venue for any and all disputes regarding your use of the Site shall be the state or federal courts located within Australia.

Copyright complaints

IMCS may, in appropriate circumstances and at its sole discretion, terminate use of the Site by any visitors who infringe on the intellectual property rights of others.
